Terms and conditions of sale

This English version is a translation; la version française fait foi (the French version prevails).

1. Scope

These terms govern sales made on vesunnaspirits.com between SPIRIT'S VESUNNA (identified in the legal notice above) and any adult individual acting as a consumer (the “customer”). Placing an order means accepting these terms.

2. No sale to minors

The sale of alcohol to minors is prohibited (article L3342-1 of the French Public Health Code). Before paying, the customer certifies being 18 or over by ticking the box provided. For pickup in Vergt, proof of identity is requested if there is any doubt about age; without it, the order is not handed over and is refunded.

3. Products and prices

Products are described on the Shop page. Prices are in euros, all taxes included. Delivery costs are added and shown before payment is confirmed.

4. Ordering and payment

The customer fills a cart, then is sent to the secure payment page of our provider Stripe, where they choose the delivery method, enter their details and, where applicable, a promotion code. Payment is taken when the order is placed. Card details are processed by Stripe and never passed on to us. The sale is concluded when payment is confirmed; a receipt is sent by email. An invoice is available on request.

5. Delivery

  • We deliver to metropolitan France only.
  • Delivery is charged at a single flat rate, whatever the number of items, shown at checkout.
  • Orders are shipped within 48 business hours of payment confirmation. Delivery usually takes 3 to 7 business days after shipping, and no more than 30 days after the order.
  • KASKAD tonics are not shipped: they are available for pickup in Vergt only. A cart that contains them only offers pickup.
  • If a parcel arrives damaged, the customer notes it with the carrier on receipt and tells us as soon as possible atvesunna.spirits@outlook.com.

6. Pickup in Vergt

At checkout, the customer can choose free pickup in Vergt (Dordogne), by appointment arranged by phone or email. Proof of identity is requested if there is any doubt about age (see article 2).

7. Right of withdrawal

The customer has fourteen days from receipt or pickup of the order to withdraw, without giving any reason (articles L221-18 et seq. of the French Consumer Code), by sending an unambiguous statement to vesunna.spirits@outlook.com or by post to 4 rue du Capitaine Malafaye, 24380 Vergt, for example using the model form below.

Products are returned no later than fourteen days after that statement, complete and in their packaging; return costs are borne by the customer. The customer may be liable for any loss in value resulting from handling beyond what is needed to establish the nature and characteristics of the products (an opened bottle, for example).

We refund all amounts paid, including standard delivery costs, no later than fourteen days after being informed of the withdrawal, using the same means of payment. The refund may be withheld until the products are received or proof of shipment is provided.

8. Legal guarantees

Products are covered by the legal guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code) for two years from delivery, and by the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). To use them, contact us at vesunna.spirits@outlook.com.

Data processed, purposes and providers

  • Orders and payment (Stripe). Name, email, delivery address, items ordered, amount. Payment is processed by Stripe Payments Europe, Limited (Ireland), which receives card details directly. Legal basis: performance of the contract. Retention: ten years, for accounting obligations.
  • Internal order notifications (Telegram). For each paid order, a message is sent to the partners ofSPIRIT'S VESUNNA on a private Telegram channel: items, amount, promotion code, delivery or pickup, customer name and town. Legal basis: legitimate interest (preparing and following up orders). Telegram's servers may be located outside the European Union.
  • Newsletter (Brevo). Email address, only after a double confirmation of sign-up. Sent through Brevo (Sendinblue SAS, France). Legal basis: consent, which can be withdrawn at any time through the unsubscribe link in every email. Retention: until unsubscription.
  • Audience measurement (Umami). Umami runs on our own servers, with no cookies and without identifying visitors: it counts page views, referrers, device type and country, as well as add-to-cart and checkout events, as aggregated statistics. Legal basis: legitimate interest.
  • Hosting (Hetzner). The website is hosted in Germany by Hetzner Online GmbH. Server logs (IP address, requested page, date) are used for the security of the website.
  • Contact. Messages received by email or phone are only used to answer you.

Cookies and local storage

This website sets no cookies. Your answer to the legal age question (remembered for 30 days) and your cart are kept in your browser's local storage and are not transmitted. The retailer map uses OpenFreeMap tiles, without cookies.

Recipients

Data is accessible only to the partners of SPIRIT'S VESUNNA and to the providers listed above, for the purposes described. It is never sold or transferred. Where data leaves the European Union, the transfer is covered by the safeguards provided for by the GDPR (standard contractual clauses or an adequacy decision).

Your rights

You have the right to access, rectify, erase, restrict, object to and port your data, and to withdraw your consent. Write to us at vesunna.spirits@outlook.com. You can also lodge a complaint with the CNIL, the French data protection authority (cnil.fr).
